Anyone considering divorce, separation, having issues with a marriage, a domestic partnership, or with any other family issues. People choosing mediation should desire an amicable, collaborative process designed for them to make the best decisions possible for their future. This client led, collaborative process helps to ensure lasting results.
Mediation is client led. This means that YOU collaborate to make the best decisions for YOUR future. There is nobody more qualified to make decisions about your/your family's future than you. Mediation can save time and money, all while supporting positive communication that will help ensure a strong agreement that will last without incident. You pay one mediator an hourly rate, rather than paying two separate attorneys.
Agreements through mediation can usually be completed in a couple of months. Every situation is unique, and clients pick the pace of the mediation. This differs from litigated separations/divorces which depend on attorney and court availability. It's not uncommon for litigated divorces to take a year or more.
First, schedule your consultation. During your consultation the process will be laid out for you in more detail and provide you an opportunity to ask questions. After the consultation you can generally expect 3-4 sessions, ranging from 1-1.5 hours in length. Time between sessions can vary depending on client availability. After agreements have been reached on all topics, the mediator will draft a Memorandum of Understanding (MOU). An MOU is a document outlining the agreement that can be converted into a formal separation/divorce agreement. Both parties will review the MOU with the mediator during the final session. After the MOU is approved by both parties it will go to an attorney, who will put the contents of the MOU in a Separation/Divorce agreement and send it to court for final approval. If clients do not already have an attorney, we have trusted attorneys we recommend.
***Even if you go to an attorney for a 'mediation' a separate attorney would have to sign the separation/divorce agreement and send it to court.
